Who is responsible for water damage in a condo in Florida?

Usually the association insures the building and you insure the inside of your unit: the finishes, fixtures, appliances and cabinets. Section 718.111(11) of Florida's condominium statute sets that split and your declaration fills in the details. An owner whose negligence caused the leak can owe the repairs that insurance does not pay.

A leak from the unit above: who to call first and who usually pays

Follow this order and start drying before anyone settles who pays.

  1. 1

    Stop the water

Knock on the door upstairs. If nobody answers, call the association manager or the maintenance line and tell them water is coming through your ceiling. Move what you can out from under it.

  2. 2

Photograph it and tell the association in writing

Take pictures of the ceiling, the walls and everything the water reached before anyone moves it. Then send the association a short written notice of what happened and when.

  3. 3

    Call your own insurer

Report it on your unit-owner policy even if you expect the association or the neighbor to pay. Ask how your insurer wants the damage documented.

  4. 4

Know which side of the line each repair falls on

The association's property policy has to leave out floor, wall and ceiling coverings, electrical fixtures, appliances, water heaters, water filters, built-in cabinets and countertops and window treatments inside the unit. Those sit on the unit owner's side. If the owner upstairs caused the leak through negligence, the repairs the association's insurance does not pay fall to that owner.

  5. 5

    Dry it now

The EPA says to dry water-damaged areas within 24 to 48 hours to prevent mold. Start the drying while the paperwork catches up. Keep the moisture log for whoever ends up paying.

Water Damage in West Palm Beach

Where water damage starts in West Palm Beach

Stacked Units in Century Village

H. Irwin Levy started Century Village in 1969 off Okeechobee Boulevard and Haverhill Road, just outside the West Palm Beach city limits in unincorporated Palm Beach County. Today it has 7,854 units run by 309 associations. In stacked units, a leak from a water heater, washer hose or toilet line upstairs runs into the walls and ceiling of the unit below, often before anyone upstairs notices.

AC Drain Lines in a Humid City

Every air conditioner pulls water out of the air and sends it down a condensate line. When algae clogs that line, the pan overflows onto the closet floor or into the ceiling below. Through a West Palm Beach summer that can mean several gallons a day going where it should not.

Storm Water Out West

In the western communities, water can sit against a slab for days after a heavy storm while the regional canals drain. Our West Palm Beach page explains why.

Our Process

What happens after you call in West Palm Beach

  1. 1

    Call Any Hour

Call 888-603-MOLD at any hour and a person answers. We tell you where to shut off the water and what to move, then schedule the crew.

In a condo we also tell you who to notify: the owner upstairs and the association.

  2. 2

    Extract

We pump out standing water and pull up soaked carpet and pad. Getting the bulk of the water out first shortens the drying that follows.

  3. 3

    Open the Walls

We cut the drywall above the water line and take out wet insulation and baseboards. That lets the block and the slab edge behind them dry.

  4. 4

    Dry to a Logged Standard

Dehumidifiers and air movers run until meter readings in the walls and slab reach a dry standard. We log every reading, which gives your insurer a record.

  5. 5

    Seal the Way In

If the water came through the foundation, we waterproof the block before the walls close up. If a pipe or an appliance failed, we tell you exactly what broke.

In a condo we write down which unit and which fixture the water came from, because your insurer and the association will both ask.

What West Palm Beach Owners Ask About Water Damage

How do I stop an AC drain line from overflowing?

Keep the condensate line clear with a little routine care. Pour a cup of white vinegar into the access port every few months, check that the float switch shuts the unit off when the pan fills and have the line flushed at every service. A wet closet floor under the air handler means it has already backed up.

Can you tell where a leak is coming from?

Usually, yes: we map moisture across the walls, floor and ceiling and follow the readings to the wettest point. In a condo that often leads to the unit above or next door. When the source is inside a pipe we cannot reach, we tell you which trade to call.

Are fans enough to dry a wall after a leak?

Fans alone will not dry a wall after a leak of any size, because they dry the surface of the paint while water stays inside the cavity and under the tile. Opening the wall where the readings are wet and running a dehumidifier is what dries it.

What if the owner upstairs is away and the leak keeps running?

Call the association manager or the maintenance line, because the association can get into the unit. Florida's condominium statute gives it an irrevocable right of access, during reasonable hours, when that is needed to prevent damage to the common elements or to another unit. In a community the size of Century Village, the owner overhead will not always be home, so keep the manager's number where you can find it.
